These Terms & Conditions ("Terms") govern your use of this website and any purchase, wholesale order, or partnership arrangement (affiliate, referral, gym, trainer, sponsorship or commission-based sales) with Motionary Sports Sdn. Bhd. ("Motionary Sports", "we", "us", "our"). By placing an order, submitting a partnership application, or otherwise using this website, you agree to these Terms.

Bhd. is registered in Malaysia (Registration No. 202601029697 / 1691792-U), with its registered address at Suite A-3-9, 8 Avenue Business Centre, Jalan 8/1, 46050 Petaling Jaya, Selangor, Malaysia. Our business covers online and offline retail, wholesale, trading, distribution, import and export of sportswear, activewear, sporting goods, fitness equipment, outdoor equipment, wellness products and accessories, and the operation of related e-commerce platforms and partnership programmes.
We take reasonable care to describe our products accurately, but slight variations in colour, packaging or specification may occur, and images shown on our website or marketing materials are for illustrative purposes. Product availability, wholesale minimum order quantities and specifications may change without notice.
Prices quoted are in Malaysian Ringgit (RM) unless stated otherwise and are subject to change without prior notice, except for orders already confirmed. Wholesale and trade pricing is provided separately upon enquiry and may be subject to minimum order quantities and payment terms agreed with you directly. Payment must be received in full (or as otherwise agreed in writing) before an order is processed for dispatch.
An order, whether retail or wholesale, is only confirmed once we have accepted it in writing (including by email or invoice) and, where required, received payment. We reserve the right to refuse or cancel an order, including where a product is out of stock, priced in error, or where we suspect fraudulent activity, in which case any payment received will be refunded.
Delivery timelines communicated at order confirmation are estimates and not guaranteed, and may be affected by courier delays, customs processes for cross-border shipments, or stock availability. Risk in the goods passes to you upon delivery to the address provided, and it is your responsibility to ensure delivery details are accurate. If a product arrives damaged, defective or materially different from what was ordered, contact us within a reasonable time of delivery with your order details and supporting photos so we can arrange a replacement, repair or refund. Beyond that, returns and cancellations for retail and wholesale orders are handled case by case and, for wholesale or trade orders, in accordance with the terms agreed at the time of order. Participation in our affiliate, referral, gym partnership, trainer partnership, sponsorship or commission-based sales programmes is subject to our review and acceptance of your application, and to any specific terms, commission rates or trade pricing communicated to you in writing at onboarding. We reserve the right to decline, suspend or terminate a partnership arrangement, including for breach of these Terms, misrepresentation, or conduct that we reasonably consider harmful to our brand. Commission or referral payouts are calculated and paid according to the schedule and structure agreed with you, and are contingent on the underlying sale being completed and paid for by the end customer.
All content on this website, including text, graphics, logos and product images, is owned by or licensed to Motionary Sports Sdn. Bhd. and may not be reproduced or used for commercial purposes without our written permission, except by active affiliate or partner accounts using approved marketing materials solely to promote our products under their programme terms.
To the fullest extent permitted by law, Motionary Sports Sdn. Bhd. is not liable for indirect, incidental or consequential losses arising from your use of this website, our products, or a partnership arrangement, except where such liability cannot be excluded under Malaysian law. Nothing in these Terms limits our liability for fraud or for matters that cannot lawfully be excluded.
These Terms are governed by the laws of Malaysia, and any dispute arising from them is subject to the exclusive jurisdiction of the Malaysian courts.
We may update these Terms from time to time. Continued use of our website or an ongoing partnership arrangement after changes are posted constitutes acceptance of the updated Terms.
